Filing a DMCA Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by sending a DMCA Notice ("Notice") to our Designated Copyright Agent as described below.   5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Filing a DMCA Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification ("Counter-Notice") to our Designated Copyright Agent, as described below. When we receive a Counter-Notice that complies with the DMCA, we may reinstate the removed material or cease disabling access to it. We will notify the party who filed the original DMCA Notice of the Counter-Notice, and if they do not file a lawsuit seeking a court order against you within 10-14 business days, we may restore the removed content.

Your Counter-Notice must be in writing and substantially include the following:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which "How To Dry Oregano In 1 Hour" may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.
